These Terms of Service (“Terms”) govern your access to and use of the website, mobile applications, online store, and services (collectively, the “Services”) provided by Too Much (“Company”, “we”, “us”, or “our”).

By accessing, browsing, or using the Services in any manner, including creating an account, placing an order, or otherwise interacting with our Services, you agree to be bound by these Terms. If you do not agree with these Terms in full, do not use or access the Services in any way.

1. Eligibility and Age Restrictions

1.1 No persons under 13 years of age are permitted to access, use, or purchase through the Services. If you are under 13, you must immediately discontinue using the Services.

1.2 Individuals aged 13 to 18 may use the Services only with verifiable parental or legal guardian consent. Parents or guardians must agree to these Terms on behalf of minors aged 13–17 and accept full responsibility for their activities, orders, and any data submitted by the minor.

1.3 Users aged 18 and above are presumed competent to contract under the Indian Contract Act, 1872 and may use the Services without additional consent. Please note that contracts with minors under Indian law are generally void from the beginning and may not be enforceable.

 

2. Acceptance of Terms and Legal Capacity

2.1 You represent and warrant that:

2.2 By using the Services, you expressly accept these Terms and agree that we may treat your use and transactions as a binding contract under Indian law, including the Information Technology Act, 2000.

2.3 Incorporation of Other Policies

By accessing, browsing, or using the Services, including placing an order or creating an account, you acknowledge and agree that you are also bound by the Company’s Privacy Policy and Refunds and Returns Policy, including the Video Proof Requirement, each of which is published separately on the website and incorporated into these Terms of Service by reference.

Your continued use of the Services constitutes your acceptance of all such policies, as amended from time to time. In the event of any conflict between these Terms of Service and any other policy, these Terms of Service shall prevail unless expressly stated otherwise.

3. Click-Wrap Agreement

3.1 These Terms constitute a click-wrap agreement. By selecting “I agree,” “Place Order,” or any equivalent action, you confirm that you have read, understand, and accept these Terms and that you intend to be bound by them.

 

4. Products, Orders, and Payments

4.1 Product descriptions, pricing, and availability are subject to change without notice.

4.2 All orders are subject to our acceptance and availability.

4.3 Payment must be made using approved third-party payment processors. We do not store complete payment card information on our servers.

 

5. Parental / Guardian Consent for Minors

5.1 If a user is aged 13 to 18, parental or guardian consent is required. The parent/guardian must:

• Provide verifiable proof of identity and consent.
• Agree to these Terms and the Privacy Policy on behalf of the minor.

5.2 We may require additional verification to confirm consent. If such consent is not received, the minor’s account may be suspended or terminated.

 

6. Limitation of Liability and Waiver of Claims

6.1 No Liability for Certain Damages:
To the maximum extent permissible under applicable law, Too Much shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary losses arising out of or related to your use of the Services or Products, including but not limited to loss of profits, loss of data, loss of business opportunities, loss of goodwill, or personal injury.

6.2 Waiver of Legal Actions:
Except to the extent that applicable law prohibits such waivers, by using the Services you expressly waive any right to bring legal actions or claims for indirect, consequential, special, punitive, or exemplary damages against the Company, its officers, directors, employees, agents, affiliates, and service providers, even if we have been advised of the possibility of such damages.

6.3 Statutory Rights:
Nothing in these Terms is intended to exclude or limit rights that cannot be lawfully excluded or limited under Indian law, including mandatory protections under the Consumer Protection Act or other consumer rights statutes.

 

Product Use, Disclaimers, and Limitation of Liability

Product Usage and Safety Disclaimer

7.1 Ingredient Awareness: All products sold under the brand Too Much are for external use only. The Customer acknowledges that it is their responsibility to read the ingredient list provided on the product packaging and the Website prior to use.

7.2 Assumption of Risk: By purchasing and using our products, you acknowledge that cosmetic products may contain ingredients to which you may be sensitive or allergic. You agree to use the products at your own risk. Too Much shall not be held liable for any adverse reactions, including but not limited to skin irritations, rashes, allergies, or other medical conditions arising from the use of our products.

7.3 Mandatory Patch Test: The Company recommends that a patch test be performed on a small, discreet area of skin 24 hours prior to full application. If irritation occurs, you must discontinue use immediately.

7.4 No Medical Advice: Any information provided on the Website or by our representatives regarding ingredients or skin types is for educational purposes only and does not constitute medical advice. For any pre-existing skin conditions, please consult a licensed dermatologist before use.

7.5 Limitation of Liability: To the maximum extent permitted by applicable law (including the Consumer Protection Act, 2019), Too Much, its directors, and employees shall not be liable for any indirect, incidental, or consequential damages resulting from product use or individual physiological sensitivities. Our total liability for any claim arising from a product shall not exceed the purchase price paid for that specific product.

 

8. Intellectual Property

All content, trademarks, trade dress, logos, and materials on the Services are owned by or licensed to Too Much. You agree not to copy, reproduce, or create derivative works without our prior written consent.

 

9. Third-Party Links and Services

The Services may contain links to third-party websites or services. We do not control, endorse, or assume any responsibility for their content or practices. Your interactions with third parties are solely between you and the third party, and the Company is not liable for any loss or damage arising from those interactions.

 

10. Indemnification

You agree to indemnify, defend, and hold harmless Too Much, its officers, directors, employees, agents, affiliates, and service providers from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Services, or your breach of applicable laws.

 

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of India.

 

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective when posted on the Services. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
